While television and movies may make it seem like most court cases are decided in court with an impassioned speech to the judge or jury, in reality this rarely happens. Instead, most court cases are determined by the written briefs submitted by each party. The complaints, pleadings, motions, briefs, and other documents filed with the court drive the entire legal system. In fact, in a number of cases, everything may be done via submitted applications and documents, with at most one short court session simply to confirm the outcome. If you are a trial attorney looking for the best possible outcome for your client, it is vital that every legal document you submit to the Court is written in a professional, accurate and persuasive manner. A written complaint that does not clearly lay out the allegations may be dismissed out of hand or serve as a shaky foundation for the case. Motions that do not properly outline the cause of action you wish the Court to adjudicate may risk facing dismissal if not presented correctly.
